Marianne T. O’Toole is a partner in O’Toole + O’Toole PLLC and practices primarily in the areas of bankruptcy, creditor’s rights, and other insolvency matters. In addition, Ms. O’Toole offers legal counsel with respect to bankruptcy protected structures for commercial real estate finance and securitization transactions, as well as general litigation counsel.
Since 2006, Ms. O’Toole has served as a standing member of the panel of United States Bankruptcy Trustees for Southern District of New York. As a member of the trustee panel, she is appointed to operate, reorganize and/or liquidate business concerns and individual bankruptcy estates under both Chapter 11 and Chapter 7 of the United States Bankruptcy Code. She has served as a post-confirmation Plan Administrator and/or Distribution Agent in several Chapter 11 cases. She has also served as a Special Master in Multi District Litigation, as well as a guardian ad litem in shareholder derivative litigation. Ms. O’Toole has served as a speaker on bankruptcy law and judgment collection on behalf of the Practicing Law Institute (PLI), the NYSBA, the Hudson Valley Bankruptcy Bar Association (HVBBA), the Westchester County Bar Association (WCBA) and the National Association of Bankruptcy Trustees (NABT). And, she has instructed students about smart financial decisions through the Credit Abuse Resistance Education (CARE) Program.
From 1993 to 2002, Ms. O'Toole served as an Assistant United States Attorney for the Southern District of New York. During her tenure and between 2000 and 2002, Ms. O'Toole served as Chief of the Tax and Bankruptcy within the Civil Division of the United States Attorney's Office for the Southern District of New York. In that capacity, she supervised and handled hundreds of bankruptcy cases on behalf of the United States of America and its agencies in the United States Bankruptcy Court for the Southern District of New York. Ms. O'Toole served as a member of the Strategic Planning Committee of the United States Bankruptcy Court for the SDNY, as well as on the Hiring Committee for both the Criminal and Civil Division of the United States Attorney’s Office for the Southern District of New York. While an Assistant United States Attorney, Ms. O'Toole represented the United States and its agencies in all phases of civil litigation, including trials and appeals in both federal and state court. She was responsible for a range of cases involving commercial law, tax, bankruptcy, fair housing, employment law, constitutional law, environmental law, and tort law.
Prior to joining the United States Attorney's Office, Ms. O'Toole was a law clerk to the Honorable Charles L. Brieant, then Chief Judge for the United States District Court for the Southern District of New York. Ms. O'Toole has practiced law in New York since 1989 when she was an associate in the New York office of an AM Law 100 Firm.
Ms. O’Toole received her J.D. in 1989 from Pace University School of Law, where she was Managing Editor of the Law Review. Ms. O’Toole is a Fellow in the American College of Bankruptcy. Ms. O’Toole is a member of the NYS Bar Association, DC Bar Association, HVBBA, NABT, NACBA and Federal Bar Council.
