The panel will discuss a trustee's rights, duties and restrictions in recovering and monetizing the estate’s interests in closely-held limited liability entities and corporations. It will also discuss the legal theories and strategies used to recover assets from non-debtor entities, including trusts, such as veil-piercing and alter ego theories. This panel will only tangentially focus on conventional fraudulent conveyance theories used to recover transferred assets.
